If Customer Content includes protected health information (“PHI”) under the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”), Caliber processes that PHI as a business associate or subcontractor, as applicable, and only as permitted by the applicable BAA and law. Rights concerning PHI should be exercised through the applicable covered entity, business associate relationship, customer process, HIPAA Notice of Privacy Practices, or HIPAA Authorization for Release of Information, as applicable.

When customers or authorized users upload medical records, litigant information, expert materials, or other case-related content to the Caliber platform, we process that information as Customer Content.
Customer Content is not governed by this Website Privacy Policy. We process Customer Content under the applicable customer agreement and, where applicable, a BAA. We use Customer Content only to provide, secure, support, maintain, and improve the contracted services as permitted by the applicable customer agreement, BAA, customer instructions, and law.
Please do not upload or submit Customer Content except through authorized platform features and secure channels provided by Caliber. Caliber processes Customer Content only to provide, secure, support, maintain, and improve the contracted services as permitted by the applicable agreement, business associate agreement, customer instructions, and law.
Unless expressly permitted by the applicable customer agreement or BAA, Caliber does not use Customer Content or PHI to train general-purpose AI models for unrelated customers.
